Terms, Conditions and Cancellation Policy
Cancellations, Refunds, and or Transfer requests must be made in writing.
Any withdrawal requests made 2 weeks prior to class starting will be offered store credit for the value of the order, or a refund for the value of the order less 25%. Refunds must be requested within 90 days of the original order date and will be issued to the purchasing credit card within 7 business days.
Requests for switching to a different class time or week of camp will incur no additional fee and will be granted provided there is room.
Withdrawal requests made within 2 weeks of the class start date, or after the class has begun, will receive store credit for the value of the original order less the prorated cost of any classes attended.
Course credits are non-transferable and holds no cash value, and cannot be exchanged for cash.
Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement:
To: Under the GUI Academy Inc. (UTG Academy) and its owners, directors, executives, employees, contractors, suppliers, participants, instructors, operators, and staff at any location where UTG activities take place (collectively, the “Releasees”).
Definitions. “Participant” means the individual attending or taking part in UTG activities. “You” means the person completing registration (the Participant if 19 years of age or older, or the parent or legal guardian completing registration on behalf of a minor Participant). “UTG activities” include camps, classes, events, and related programs.
Assumption of risks. UTG activities involve risks, dangers, and hazards that can result in illness or injury. Exposure to infectious disease, including COVID-19, is one such risk. Participants may design, fabricate, wire, program, test, and compete with robots in shop environments, including use of or proximity to: drill press, band saw, miter saw, table saw, scroll saw, belt or disc sander, milling machine, lathe, CNC router, laser cutter, hand drill, angle grinder, rotary tool, soldering iron, heat tools, adhesives and solvents, electrical systems, batteries, and material handling equipment. Risks include cuts, lacerations, crush and pinch injuries, eye injury, hearing damage, burns, electrical shock, battery failure or venting, inhalation of fumes or particulates, repetitive strain, tripping, and other injuries inherent to shop and robotics activities. Participation is voluntary and involves risks that cannot be eliminated.
I AM AWARE OF THE RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH UTG ACTIVITIES AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR LOSS RESULTING THEREFROM.
Release of liability, waiver of claims, and indemnity. In consideration of the Releasees allowing the Participant to take part in UTG activities, you agree as follows:
  1. Waiver of claims. You waive any and all claims that you have now or may have in the future against the Releasees for any loss, damage, expense, or injury, including death, that you may suffer or that your next of kin may suffer as a result of the Participant’s participation in UTG activities, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty owed under the Occupiers Liability Act, R.S.B.C. 1996, c. 337, on the part of the Releasees. Negligence includes failure to take reasonable steps to safeguard or protect from, or warn of, the risks, dangers, and hazards of participating in UTG activities.
  2. Indemnity. You will hold harmless and indemnify the Releasees from any and all liability for property damage or personal injury to any third party resulting from the Participant’s participation in UTG activities.
  3. Binding effect. This Release Agreement is effective and binding upon you and the Participant, and your and the Participant’s heirs, next of kin, executors, administrators, assigns, and representatives, including in the event of death or incapacity.
  4. Governing law. This Release Agreement and any rights, duties, or obligations between the parties are governed by and interpreted solely in accordance with the laws of British Columbia.
  5. Jurisdiction. Any litigation involving the parties shall be brought solely within British Columbia and within the exclusive jurisdiction of its courts.
No other representations. In entering into this Release Agreement, you are not relying on any oral or written representations or statements made by the Releasees with respect to the safety of UTG activities other than what is set out in this Release Agreement.
Fitness and information. You acknowledge the inherent risks of participation and confirm the Participant is of suitable fitness to participate. If you require more information about program risks, you will contact the person in charge of the program.
Medical authorization and insurance. In the event of accident or injury, you give permission and authorize UTG Academy staff to provide appropriate first aid or obtain medical services for the Participant. You understand that UTG Academy does not carry or maintain health, medical, or disability insurance for Participants, and you will be responsible for any costs associated with health emergencies or injuries sustained during UTG activities.
Sunscreen. If needed during UTG activities, you give permission to UTG Academy staff to apply sunscreen to the Participant.
Right to refuse services. UTG Academy reserves the right to refuse to render class or camp services to any Participant with or without reason or cause.
Acknowledgment and consent. By registering, you agree to the following policies and confirm that you have read and understand this Release Agreement. If you are the parent or legal guardian of a minor Participant, you provide these acknowledgments and consents on your own behalf and on behalf of the minor Participant.
Media Release
Throughout the school year and camps, students, and student generated content may be highlighted in efforts to promote Under the GUI activities and achievements. For example, students may be featured in materials to increase public awareness of our school through newspapers, radio, TV, the web, DVDs, displays, brochures, newsletters and other types of media. It is important for us to know your wishes regarding division and media coverage of student achievements and events. If you do not wish to have media coverage of your child, please inform us immediately prior to the start of the school year or camp.
